This legal agreement (“Agreement”) between you (“You/r” or “user” or “Member”) and Roster Point, Inc. (“Roster Point” “us,” “we” or “our”) that may be contacted at 170 Seneca Ave, Oshawa, Ontario, L1G 7S6, Canada represents your legal binding to the website. Member and Roster Point are referred to herein, each, when separately, as a “Party,” or when collectively, as the “Parties.”

By visiting our website www.rosterpoint.com, purchasing any product/service, signing up for newsletter or by clicking the “I accept” or “I agree” button, you denote your legally‐binding agreement to the following Terms and Conditions. If you do not agree to these terms and conditions, we encourage you to close this webpage.

The Roster Point Services include the following, without limitation: Services for Hockey Team Member, and Services for Player Member. We may offer additional Services or revise any of the Services at our sole discretion.

Roster Point reserves the rights to change or terminate any feature or service; or to restrict your access to some portions of website in the case that we find that you are engaging in an activity that is inappropriate or that violates these terms and conditions.

Use of Logo – By agreeing to these terms and conditions you are giving us access and approval to use your team logo on the first page of our website.  The logo will remain on our site for as long as Roster Point is in business. You wave the need to for Roster Point to request permission to use your logo for your teams promotion and Roster Point’s promotion of your team.

Eligibility:

  1.     Minimum Age: To use this website or register for the services of this website, you must be 13 years of age or have your parents consent. If you are younger than 13 years of age your parents must register you for a profile on Roster Point.  It is the position of Roster Point’s owner(s) that parents register their children so any communication between a team and the player is seen by a parent. This is recommended for any player under the age of 18 years. You agree that you provide accurate information that may be verified at any time.
  2.     Criminal History: We do not conduct background checks on our members, making you, the user, solely responsible for taking precautions while contacting other members.
  3.     You are a hockey player. Junior hockey is ice hockey competition generally for players between 15 and 21 years of age. Junior hockey leagues in the United States and Canada are considered amateur (with some exceptions) and operate within regions of each country. In Canada, the highest level is major junior, which itself has three constituent leagues: the Ontario Hockey League, Quebec Major Junior Hockey League and the Western Hockey League. The second tier is Junior A, governed nationally by the Canadian Junior Hockey League. A limited number of teams in the Canadian Major Junior leagues are also based in the United States. In Europe, junior teams are often sponsored by professional teams, and act as development and feeder associations for those organizations. Junior hockey is one level above minor hockey, the level of ice hockey played by youth.
  4.    You are the parent of a hockey player. You wish your son or daughter to be playing hockey at a higher level than he or she is currently playing.
  5.     No False Information. You agree that every content or information you provide will not be inaccurate, false or misleading, neither to us nor to any user. If any information or content becomes as such, you will quickly contact us of the change that happened.

We reserve the right to withdraw or change website features at any time and by any means without prior notice. This may result from a mistake, malware, technical issue, glitches, fraudulence, illegal involvement, tampering, or any other reason that interferes with or prohibits the appropriate conduct of this website, company, or campaigns.

However, rosterpointhockey.com will not be held liable for these issues or any and all damages they may cause.

User Conduct:

When creating a profile, posting an auction, contacting other members, posting anything on our social media accounts, or visiting any page, you will NOT:

  •       Disclose any confidential information about other users without their permission
  •       Engage in any kind of offensive behavior (pornography, racism, abusiveness, harassment etc.)
  •       Forward chain letters using our website
  •       Use picture that does not belong to you. You are not permitted to impersonate anyone.
  •       Infringe any third party’s rights
  •       Upload any malicious software, virus etc that could disrupt the working of system tools, servers, networks
  •       Try to sell other users’ information to third parties
  •       Try to access our services through automated robots, or conduct attacks such as Denial of Service
  •       Promote products/services on our website with the exception of Advertising which has been approved.

USE OF SERVICES

  1.     Personal Use‐ Your membership account is solely for your own personal use. You may not allow others to access or use your account. You may not transfer your account to any other person. You agree that we, as the owners of this website, are not responsible for third party access to your account that in any way results in theft or illegal usage, storage, or sale of your personal information.
  2.     Reporting of Violations. You will immediately contact us when you notice (i) any possible violation of the Agreement by anyone, and (ii) any unauthorized access to your account, whether known or not.
  3.     Content Removal. Any information or content you submit will be available to us for monitoring. We keep the rights to remove any information that in any way violates any possible law of the Services or any third party.
  4.     No False Information. You agree that every content or information you provide will not be inaccurate, false or misleading, neither to us nor to any user. If any information or content becomes as such, you will quickly contact us of the change that happened.
  5.     No Advertising or Commercial Solicitation. You agree that you will not try to persuade any other user to buy or sell products. You must not send any chain letters, spam or junk email to other users of the Services. Furthermore, you agree that the information that you get from the Services will not be used by you in means of selling, advertising and such until the approval of the other user. By agreeing with this you acknowledge the fact that any breach of the terms will cause significant damages to us, and you have all the responsibility since that damage will be hard to assess.
  6.      No Harassment of Employees or Agents. You agree that you will not harass, pressurize or threaten any agents or employees responsible for providing the Services to you.
  7. Every hockey association has rules and procedures surrounding TAMPERING with or colluding with or against another team or organization.  Roster Point will NOT be held responsible for any kind of this type of behavior from our clients. We recommend that users follow their local organizations rule and procedures when recruiting players from outside of their organization. We do have the ability to assist in anyone with allegations of such a thing happening.  We reserve the right to with hold information and only release what we feel is necessary to resolve any issues.
  8. Roster Point Hockey has a built in messaging system to allow players and teams, players and players and teams and teams communicate with one another. This messaging system uses the users own personal email address to send and receive messages. Roster Point Hockey can view these messages at anytime to ensure no rules are being broken, no foul language is being used and no harassment of any kind is happening, you agree to allow us to read your personal messages to ensure system compliance is being met.
  9. Contacting a player or parent for any other reason than hockey is prohibited. Any signs of the messaging system being use to bully, intimidate, harass or to make contact with a minor will be reported to the authorities immediately.
  10. Any signs of spamming will not be tolerated.

Canada

In Canada, the junior hockey is divided into several tiers, and players aged 16–20 or 15‐ 21 at the beginning of the season are eligible. Hockey Canada is enacting rules designed to limit the number of 16‐year‐olds allowed to play junior hockey, preferring most remain at the midget level.

Major Junior

Major junior hockey is overseen by the Canadian Hockey League (CHL), which acts as the governing body for its three constituent leagues: Quebec Major Junior Hockey League (operating in Quebec and Atlantic Canada with 18 teams), Ontario Hockey League (operating in Ontario, Pennsylvania, and Michigan with 20 teams), Western Hockey League (operating in Western Canada, Washington, and Oregon with 22 teams). The CHL currently places a cap of three 20‐year‐old or overage players per team, while only four 16‐year‐olds are permitted.

Many of the top North American prospects for the professional National Hockey League (NHL) play in the one of the CHL leagues. The champion of each league competes in an annual tournament with a predetermined host team for the Memorial Cup, Canada’s national Major Junior championship. Up until 1970, the leagues that became Major Junior and Junior A today were both known as Junior A. In 1970 they were divided into Tier I Junior A or Major Junior A and Tier II Junior A. In 1980, the three Major Junior A leagues opted for self‐control over being controlled by the branches of the Canadian Amateur Hockey Association and became Major Junior hockey, Tier II Junior A became the top tier of hockey in these branches and became Junior A hockey.

Junior A

Junior A (junior AAA in Quebec) hockey is one level below the CHL. Junior A was referred to as Tier II Junior A in the 1970s, until what was called Major Junior A broke away from their regional branches in 1980 and became the Canadian Hockey League and Major Junior hockey, at this time, the term Tier II was dropped from what is now Junior A hockey. It is governed by the Canadian Junior Hockey League, which oversees eleven constituent leagues across Canada. The national championship is the Royal Bank Cup.

Junior A teams are considered amateur by the NCAA, thus players intending to go to American universities tend to choose this route rather than play in the CHL. Junior A teams tend to play in much smaller markets than CHL teams, and thus play to much smaller crowds.

Junior B, C, D

Formulated in 1933, Junior B (junior AA in Quebec) differentiates between teams capable for Memorial Cup competition and those who are not. The major championships across Canada are the Sutherland Cup in Southern Ontario, the Carson Trophy in the Ottawa District, the Coupe Dodge in Quebec, the Don Johnson Cup in the Atlantic Provinces, and the Keystone Cup which represents all of Western Canada, from British Columbia to North western Ontario.

Junior C (junior A in Quebec) is generally a local based system, but is considered competitive in some regions, and serves as seeding or farm‐teams for Junior B teams. Ontario Junior C Hockey has 6 rounds of playoffs

Junior D was popular in the 1960s and 1970s in dense population centers, but fell off in the early 1990s. In Quebec, Junior D is now known as Junior B and is run strictly by minor hockey associations.

United States

As in Canada, junior hockey in the United States is subdivided into several levels with most being sanctioned by USA Hockey. Currently, 11 American teams play in the Canadian junior system, with eight in the Canadian Hockey League and three in junior A leagues. At junior A level, one team in the British Columbia Hockey League is from Washington, one in the Northern Ontario Junior Hockey League is from Michigan, and one in the Ontario Junior Hockey League is from New York.

Tier I

The United States Hockey League (USHL) is currently the only Tier I league in the country, consisting of teams in the central and Midwestern US. The USHL provides an alternative to Major Junior Hockey for kids who want to play in the NCAA, before seeking the NHL. While playing in the USHL, all player expenses are paid for by the team; no membership or equipment fees are charged.

Tier II

Currently the North American Hockey League is the only USA Hockey‐sanctioned Tier II league in the United States. The NAHL is the largest junior hockey league in the US and consists of teams spread across the Western two thirds of the United States with a significant concentration of teams in the central and south western parts of the United States.

Tier III

USA Hockey currently has ten sanctioned Tier III leagues:

  • Eastern Hockey League
  • Metropolitan Junior Hockey League
  • North American 3 Eastern Hockey League
  • North American 3 Hockey League
  • Northern Pacific Hockey League
  • Rocky Mountain Junior Hockey League
  • United States Premier Hockey League

AAU

The Amateur Athletic Union returned to sanctioning the sport of ice hockey in 2011. Prior to the 2011–12 season, the Western States Hockey League became the first large‐ scale junior league to exit USA Hockey in favor of the AAU. Currently all junior hockey leagues under the UHU umbrella operate under a similar pay‐to‐play USA Hockey Tier III structure, although the WSHL is considered Tier II within the UHU hierarchy. United Hockey Union junior hockey leagues:

  • Western Prospects League – Tier III status
  • Western States Hockey League – Tier II status
  • World United Hockey League – Junior A/Tier III status

Independent leagues (Canada and US)

Some leagues that refer to themselves as Junior A also operate outside the control of the Hockey Canada and USA Hockey. Presently, the Greater Metro Junior A Hockey League is operating as an independent league in Ontario and western New York. In the Winnipeg area the Manitoba Major Junior Hockey League is operating as a non‐ sanctioned league. While a leagues can claim to be comparable to Junior A leagues, due to the lack of regulation the actual level of play may vary. In addition to independent leagues, there are also independent teams, such as the Jamestown Jets, although these usually result from league problems or other disputes.

Europe

In Europe, junior teams are usually associated with a professional team, and are used by professional teams to develop their own prospects.

The lack of an amateur draft in Europe, other than in Russia, means that the onus is on the teams to sign the most talented young players they can get, and the presence of an affiliated junior team provides a place for young players who aren’t yet ready for the rigors of the professional game to develop. However, not all players on a European

Junior team are necessarily the property of their professional club, and may elect to sign elsewhere.

Minor hockey is an umbrella term for amateur ice hockey which is played below the junior age level. Players are classified by age, with each age group playing in its own league. The rules, especially as it relates to body contact, vary from class to class. In North America, the rules are governed by the national bodies, Hockey Canada and USA Hockey, while local hockey associations administer players and leagues for their region. Many provinces and states organize regional and provincial championship tournaments, and the highest age groups in Canada and USA also participate in national championships. Minor hockey is not to be confused with minor league professional hockey.

In Canada, the age categories are designated by each provincial hockey governing body based on Hockey Canada’s guidelines, and each category may have multiple tiers based on skill.

Age categories

To qualify in a category, the player must be under the age limit as of December 31 of the current season.

Initiation (Mini Mite): under 7 years of age AKA Hockey 1 and Hockey 2 and previously known as Mite and Tyke respectively.

Novice (Mite): under 9 years of age AKA Hockey 3 and Hockey 4 Atom (Squirt): under 11 years of age

Peewee: under 13 years of age Bantam: under 15 years of age Midget: under 18 years of age

Juvenile under 20 years of age, for players who want to remain in hockey at a minor hockey association level. Those not playing Junior or playing Senior.

Junior: under 21 years of age Junior: divided into Major Junior (WHL, OHL and QMJHL), Junior A (Tier II Junior), Junior B and Junior C (in some locations).

Senior: No age limit Skill categories

There are two broad grouping of skill levels: competitive and non‐competitive. From house league/recreation hockey, progression is made to competitive travel hockey. A competitive team will hold tryouts and players will be selected for the roster depending upon skill level and fit. At this level, players chosen to compete experience a higher level of on‐ice competition and coaching. Players learn systems; coaches maximize his/her potential and train them to work together as a unit.

Competitive

Higher‐skilled players will typically play on “representative” or “travel” teams that will travel to play representative (rep) teams from other areas. These teams are classified by skill. Not all cities will have teams at all skill levels, depending on size and the popularity of hockey, however even small communities may field teams at multiple levels. (For example: Orillia, Ontario, with a population of 30,000, has four distinct skill divisions for 7‐year‐olds.) The classifications are typically not certified by any external organization, so there is speculation about what levels are truly better or stronger than others. AAA, AA, and A hockey are nationally recognized as competitive levels of organized hockey, with AAA being elite competition. The competitive level players generally engage in high levels of physical play from a young age. This physical play can lead to injuries and most often these are related to the head. Injuries have become more prevalent as physical play has increased in the sport.

‘AAA’ is the highest calibre of minor hockey British Columbia

In British Columbia, BC Hockey has a different system for competitive teams. Midget Rep has a BC run Midget AAA league.

All other Rep teams (Atom to Juvenile) are exclusively inter association under the guidance of PCAHA (Pacific Coast), OMAHA (Okanagan), VIAHA (Island), and are labeled as A1, A2, A3, and A4. No Atom level Provincial championship exists as Atom is considered developmental and non‐competitive.

Quebec

Quebec house leagues are labeled C, B, A. Competitive teams are labeled “Double Letters” CC, BB, AA (Atom through Midget Levels) and ‘Triple Letters’ AAA (starting at Peewee through Midget). Body checking starts only in “Double Letter” Bantam BB. Midget offers the ‘Espoir’ Level (only 15‐year‐olds) which is basically between AA and AAA Levels. The following are the Levels currently played in the Province of Quebec, as sanctioned by Hockey Quebec:

United States

In the United States, USA Hockey designates the following levels: Mite (ages 8 & under) (Levels AA, A, B)

Squirt (ages 9–10) (Levels AAA, AA, A, B, C) Peewee (ages 11–12) (Levels AAA, AA, A, B, C) Bantam (ages 13–14) (Levels AAA, AA, A, B, C)

Midget Minor 16 and Under (ages 15–16) (Levels AAA, AA, junior varsity high school‐A)

Midget Major 18 and Under (ages 15–18) (Levels AAA, AA, varsity high school‐AA and AAA)

Junior (ages 16 to 20) (Cut‐off age varies depending on the league)

Many organizations and leagues that have larger numbers of registered players tend to delineate within the two year window allowed for each age group. In these situations, teams composed entirely or primarily of players in their second year of eligibility are designated ‘major’ teams, while those with players in their 1st year of eligibility are designated ‘minor’ teams. (For example, ten‐year‐olds would be ‘squirt majors’ while nine‐year‐olds would be ‘squirt minors.’) This is especially true in “AAA”.

Some leagues separate players six years old and younger into their own group, often referred to using names like “Mini‐Mites,” “Mosquitoes,” or “Microns.”

USA Hockey designates four skill levels:

  • Tier 1: The Highest Level of Competition, commonly called “AAA”, following the Canadian system.
  • Tier 2: The Next Higher Level of Competition, commonly called “AA” or “A”, following the Canadian system.
  • Tier 3: The Next Higher Level of Competition (Not all districts use this designation), may also be called “A”, the lowest level of competitive hockey.
  • Recreational/Developmental: Includes House League and Select (House All‐Star) Teams. May be called “B”, “C”, etc.

AAU

The Amateur Athletic Union has returned to licensing the sport of Ice Hockey.

During recent years, the AAU has sanctioned several High School Varsity, Junior Varsity and Middle School leagues within the state of New York.

During the 2011‐2012 season the AAU began licensing Junior and youth leagues as well. The Western States Hockey League (WSHL) moved their operations from USA Hockey into AAU and Hockey Michigan was formed, providing Mite (8&under) conventional full‐ ice playing opportunities in the face of cross‐ice mandates adopted by the USA Hockey district affiliate. During the 2012‐2013 season, AAU Junior and Youth operations have been expanding rapidly and currently span coast to coast.

Although some AAU clubs still use classification terms such as Mites‐Midgets, the more correct AAU youth designations are:

6U (ages 6 and younger) 7U (ages 7 and younger) 8U (ages 8 and younger)

9U (ages 9 and younger) 10U (ages 10 and younger) 11U (ages 11 and younger) 12U (ages 12 and younger) 13U (ages 13 and younger) 14U (ages 14 and younger) 15U (ages 15 and younger) 16U (ages 16 and younger) 17U (ages 17 and younger) 18U (ages 18 and younger)

Finland

In Finland, the Finnish Ice Hockey Association roughly categorizes minor hockey players to under school‐ages and school‐ages. Children over 16 are considered as juniors, although the youngest juniors are still at the school‐age. Minor and junior hockey levels are:

G‐ and F‐minors (age 11 and younger) E‐minors (ages 12 to 13)

D‐minors (ages 14 to 15) C‐juniors (age 16 and younger) B‐juniors (age 18 and younger) A‐juniors (age 20 and younger)

France

Teams use the following levels:

Moustiques (age 9 and younger)

Poussins (ages 10–11)

Benjamins (ages 12–13)

Minimes (ages 14–15)

Cadets (ages 16–18)

Germany

German Ice Hockey Federation designates the following levels: Kleinstschüler (Bambini) (ages 9 and younger)

Kleinschüler (ages 11 and younger) Knaben (ages 13 and younger) Schüler (ages 15 and younger) Jugend (ages 17 and younger) Junioren (ages 19 and younger)

All levels are administrated by the respective sub‐federation in each province except for the federal leagues which are administrated directly by the German Ice Hockey Federation. Ages were raised in 2010/2011.

Sweden

The Swedish Ice Hockey Federation designates the following levels: U9 (ages 9 and younger)

U10 (ages 10 and younger) U11 (ages 11 and younger) U12 (ages 12 and younger) U13 (ages 13 and younger) U14 (ages 14 and younger) U15 (ages 15 and younger) U16 (ages 16 and younger) J18 (Juniors 18 and younger) J20 (Juniors 20 and younger)

You agree to pay the price in full specific to Your level of membership during the checkout process before we are obligated to provide You with that level of access to our Site and its Services. Failure to timely pay the Membership Fees shall result in default and shall constitute a material breach of the terms of this Agreement.

There shall be no cancellations, partial or full refunds, or any other form of returns of Your payment once received, as all purchases shall be deemed final.

Membership levels for Teams are as follows:

Memberships for Players

Gold = Full access to all the site features.

Player Promotion Activities on our social media platforms are paid services unless otherwise stated.  Roster Point reserves the right to promote individual players as we see fit. Fees will be charged based on the Promotion Package a player chooses.  Payments will be charged on an individual basis using a third party payment software.

There are other options included as your service and price level go up, such as searching and matching players or teams, messaging, viewed profiles, number of views, adding video and these options are only allowable to You if you pay a subscription for these services. Player and Team subscriptions will auto renew on the one year anniversary of the original registration date.

TRADEMARKS AND COPYRIGHT OWNERSHIP

All data and content, in any form, contained by or offered through the website and all intellectual property rights relating to said content are the sole property of Roster Point. This includes all information, content, photographs, articles, text, video, images, functions, or other content.

This website itself or any section of this website may not be duplicated, sold, reproduced, copied, resold, visited, or otherwise used for commercial purposes excluding the possession of express written consent from the website or company owner(s). You may not utilize “hidden text”, hereafter defined as being of the same purpose as meta tags, without the company’s express written consent. Any unauthorized use of hidden text terminates any license granted by the company and associated companies and voids these Terms and Conditions. You may be prosecuted for such actions.

GOVERNING LAW

This Agreement shall be interpreted, construed, and governed by the laws of the Province of Ontario, Canada without reference to its laws relating to conflicts of law and not including the provisions regarding the international sale of goods.

INDEMNIFICATION

You agree to defend, indemnify, and hold harmless the company and any associated companies and their associates from and against all liabilities, damages, and costs resulting from the violation of these terms and conditions. This wrongful or negligent conduct, whether conducted by yourself or any other person accessing the website using your information, will be assumed to have been conducted by you and is in no way reflective upon or liable to the website or its company.

DISPUTE RESOLUTION

In the event that a dispute arises between any Member(s) and Roster Point concerning our Site and/or Services (“Dispute”), representatives of the Parties shall promptly meet within the boundaries of Oshawa, Ontario, unless otherwise agreed by the Parties, as soon as reasonably possible, but not later than 45 days after the sending of a written notice of a Dispute and the Parties shall engage in good faith negotiations aimed at resolving the Dispute (“Good Faith Negotiations”). If the Parties are unable to resolve such Dispute satisfactorily within 45 days from the date of receipt of such written notice of a Dispute, either Party may submit the Dispute to arbitration by serving the other Party with a written notice of the intention to arbitrate, as provided for below.

SEVERABILITY

Any provision of this Agreement that is held or adjudged invalid, prohibited or unenforceable in any jurisdiction shall, as to that jurisdiction, be ineffective to the extent of such invalidity, prohibition, or unenforceability, and shall be severed from the balance of this Agreement, all without affecting the remaining provisions of this Agreement or affecting the validity or enforceability of such severed provision in any other jurisdiction. The Parties agree in good faith to promptly reformulate any such invalid, prohibited, or unenforceable provision to preserve the original intentions and objectives of this Agreement and to remove such illegality, invalidity, or unenforceability to the extent possible without materially reducing the value of this Agreement to any Party.

OUR LIABILITY

We do not guarantee any measure of accuracy of our content and information on our website or any associated social media platforms. We do not guarantee accuracy for any warranties, liability, or any other damages caused by violation of this agreement. The following is a list where we do not offer accuracy:

  • Any form of warranty posted on any terms or through any medium which might be implied by law.
  • Roster Point or any of it’s employees or contractors do not guarantee that any single player will get drafted into a higher level league. We also do not guarantee that any player will find what they perceive to be perfect conditions.
  • Use of our messaging system is 100% the responsibility of the user. Any physical or mental harm that one perceives to have been done as a result of using our messaging system is the users responsibility. Players under the age of 18 should be have the permission of their parent or guardian to be on this site.
  • Any form of liability attached to any loss or damages from using our website. Said loss or damages have no limitations and result from the posts of other users, by using our website, or any hyperlinks or advertisements that are in any way associated with our website. They can include:

  1. Player Self Made Interview Videos
    1. All videos sent to us will not be returned or deleted unless we are legally asked to do so.
    2. It is our right to play the videos that we deem will promote Roster Point in the best fashion
    3. We withhold the right to not play videos we deem as not promoting Roster Point in the best fashion
    4. If a video is requested by any other person other than the sender we will do our best to notify the sender of the request prior to releasing the video
    5. All videos will become Roster Point Property once received and we are free to edit or modify them in any way we see fit.
    6. We are not responsible for any liable damage caused by playing any video sent to us.
    7. We are not responsible for any harm any video played causes anyone today in the past and in the future.
    8. Roster Point is not responsible for paying any postage to or from our office for any videos
  2. Player Ambassador Program
    1. A player can only win the Ambassador title once a calendar year.
    2. Roster Point reserves the right to take away the title of RP Ambassador if we feel the player is acting or has acted in a negative fashion in public or caught to have in private.
      1. If the player has used vulgar or abusive language towards any other person
      2. Is known to be a racist or use racist like slurs towards any other human being
    3. The title of RP Ambassador last for 3 months and then another player is awarded with the title
    4. The Ambassador is entitled to receive prices from Roster Point and some of our partners. We will mail these prizes to the address given but will not be responsible for them after they leave our hands.
  3. Roster Point T Shirt Policy
    1. Anyone who receives a T Shirt from Roster Point is required to take a selfie with it on and send this picture out on their social media accounts with a kind message to all of their followers about Roster Point.
    2. There are multiple ways to get a T Shirt and we encourage players to contact us and request a T Shirt at any time. You will be asked to do something for the T Shirt.
  4. Player Exposure Services
    1. The RPH Player Exposure Services consist of posting the player’s image, current stats and the players own comments from his profile’s biography on our social media accounts in an effort to give the player exposure to our followers and our affiliate’s social media followers. Exposure Services consist of the following

      3. Platinum Player Promotions
      4. Player Showcase Emails
    2. The duration of the player promotion is agreed upon with the player and Roster Point.
    3. Roster Point does not make any guarantees that any player will be drafted, or signed by a junior team, AAA Team or any team the player aspires to play for.
    4. Roster Point is offers an Advisor Service which is included in the Platinum Player Promotion
    5. Roster Point is not an Agent Service
    6. Roster Point may offer consultation with the player and his family but only in the form of information, RPH does not recommend or endorse any hockey team or collegiate opportunities.
    7. Roster Point only facilitates the meeting of players and teams from across the world.
    8. Roster Point is not liable for any circumstances that arise as a result of a any player or any team meeting with the other including conversing.
    9. Players and parents must do their own due diligence when considering any playing opportunity. Roster Point may suggest opportunities that are available by way of mass email and social media posts but this does not mean we endorse any opportunity

    10. Players and Teams use Roster Point at your own risk.
    11. Roster Point has taken every possible precaution to protect the identity of our users but if you want to be hidden from public view you can do so in your account settings.
  5. Player Video Services
    1. All video received from the player or the photographer hired by Roster Point will be retained by Roster Point for any future scouting or promotional use.
    2. Roster Point reserves the right to refuse any player submitted video on the grounds of poor quality or any other reason that deems it unusable.
    3. The editing process is the sole creative process of the editor with input from Roster Point. Any special requests from the player will be handled on a case by case basis.
    4. With the submission of video or the hiring of a photographer, the player willfully acknowledges and allows the use of the video on the Roster Point website, Twitter, Facebook, Instagram, and any other social media platform needed for proper player promotion.
    5. Removal of any video from the Roster Point website or social media will be handled on a case by case basis at the request of the player.
    6. The creative process of the video style is a collaborative effort between the hired photographer and Roster Point. Input from a player for any special requests regarding the shooting of a game will be submitted to Roster Point prior to the date of the filming of the game. Roster Point or the photographer reserves the right to refuse any special requests if believed to be detrimental to the overall production of the scouting video.
    7. Roster Point reserves the right to refuse video service to any client.

ROSTER POINT HOCKEY PLAYER ADVISORY SERVICE
Preamble
The License has been adopted by Roster Point Hockey (RPH) for its licensees, contractors, and employees, to provide principles and rules to all persons whom it has recognized and certified to use the association with Roster Point Hockey, and its logo Trademarks (collectively, the “Trademarks”).
These Trademarks are owned by Roster Point Hockey and is the sole organization, which is recognized and authorized to use these Trademarks.
Implicit in the company’s acceptance of this authorization is an obligation not only to ensure compliance with the mandates and requirements of all applicable laws and regulations, but also to require associated professionals to act in an ethical and professionally responsible manner becoming of the profession.
For purposes of this License, a person recognized and certified by Roster Point Hockey to use the Trademarks is called RPH Management, Sales, Admin Staff and Contractors. This License applies to all professionals actively involved in the practice of player exposure services while under the auspices of Roster Point Hockey or in another related profession, in the performance of their professional responsibilities in relation to the clients of Roster Point Hockey, including those of its licensees and contractors.
In addition, some principles, specifically Principle 1 and Principle 6, also apply more generally to the activities of RPH Management, Sales, Admin Staff and Contractors even when acting outside the scope of their capacity as an Athlete Support Person.

Composition and Scope
The License consists of two parts: Part 1 – Principles and Part II – Rules.
The Principles are statements expressing in general terms the ethical and professional ideals of RPH Management, Sales, Admin Staff and Contractors, ideals they should strive to display in their professional activities. As such the Principles are intended to be a source of guidance for our RPH Management, Sales, Admin Staff and Contractors.
The comments following each Principle further explain the meaning of the Principle. The Rules provide practical guidelines derived from the tenets embodied in the Principles. As such, the Rules set forth the standards of ethical and professional conduct expected to be followed in particular situations. This License does not undertake to define standards of professional conduct of RPH Management, Sales, Admin Staff and Contractors for purposes of civil liability.
The License is structured so that the presentation of the Rules parallels the presentation of the Principles. For example, the Rules which relate to Principle 1 (Integrity) are numbered in the
100 to 199 series while those Rules relating to Principle 2 (Objectivity) are numbered in the 200 to 299 series.

Part I – Principles
Introduction
These Principles of the License recognize the individual RPH Management, Sales, Admin Staff and Contractors responsibilities to the public, clients, colleagues, employers and to the profession. They apply to all RPH Management, Sales, Admin Staff and Contractors employed or contracted by Roster Point Hockey. in all aspects of their work and provide specific guidance to them in the performance of their role.
Principle 1: Integrity
All RPH Management, Sales, Admin Staff and Contractors shall always act with integrity.
RPH Management, Sales, Admin Staff and Contractors may be placed by clients in positions of trust and confidence. The ultimate source of such public trust is the RPH Management, Sales, Admin Staff and Contractors ’s personal integrity. In deciding what is right and just, RPH Management, Sales, Admin Staff and Contractors should rely on his or her integrity as the appropriate touchstone. Integrity demands honesty and candor that must not be subordinated to personal gain and advantage. Within the characteristic of integrity, allowance can be made for legitimate difference of opinion; but integrity cannot co-exist with deceit or subordination of one’s principles. Integrity requires the RPH Management, Sales, Admin Staff and Contractors to observe not only the letter but also the spirit of this License.

Principle 2: Objectivity
RPH Management, Sales, Admin Staff and Contractors shall be objective in providing services to clients. Objectivity requires intellectual honesty and impartiality. It is an essential quality for any professional. Regardless of the particular service rendered or the capacity in which an RPH professional function, a professional should protect the integrity of his or her work, maintain objectivity, and avoid the subordination of his or her judgment, which would be in violation of this License.

Principle 3: Competence
RPH Management, Sales, Admin Staff and Contractors shall provide services to clients competently and maintain the necessary knowledge and skill to continue to do so in those areas in which the RPH Management, Sales, Admin Staff and Contractors is engaged. One is competent only when one has attained and maintained an adequate level of knowledge and skill and applies that knowledge effectively in providing services to clients.
Principle 4: Fairness
RPH Management, Sales, Admin Staff and Contractors shall perform duties in a manner that is fair and reasonable to clients, principals, partners, and employers and shall disclose conflicts of interest in providing such services.
Fairness requires impartiality, intellectual honesty, and disclosure of conflicts of interest. It involves a subordination of one’s own feelings, prejudices, and desires so as to achieve a proper balance of conflicting interests. Fairness is treating others in the same fashion that one would want to be treated and is an essential trait of any professional.
Principle 5: Confidentiality
RPH Management, Sales, Admin Staff and Contractors shall maintain confidentiality of all client information. A client, by seeking the services of RPH Management, Sales, Admin Staff and Contractors, expects to develop a relationship of personal trust and confidence. This type of relationship must be built upon the understanding that information supplied to the RPH Professional will be confidential.
Principle 6: Professionalism
RPH Management, Sales, Admin Staff and Contractors conduct in all matters shall reflect credit upon the profession. RPH Management, Sales, Admin Staff and Contractors shall behave in a manner that maintains the good reputation of the profession and its ability to serve the public interest. RPH Management, Sales, Admin Staff and Contractors shall avoid activities that adversely affect the quality of his or her student-athlete business relationship.

Principle 7: Diligence
RPH Management, Sales, Admin Staff and Contractors shall act diligently in providing student-athlete promotion. Diligence is the provision of services in a prompt and thorough manner. Diligence also includes proper services for and supervision of the rendering of professional services.
PART II – RULES
Introduction
These Rules provide practical guidelines derived from the tenets embodied in the Principles. As such, the Rules set forth the standards of ethical and professionally responsible conduct expected to be followed in particular situations.
Principle 1: Integrity
RPH Management, Sales, Admin Staff and Contractors shall always act with integrity.
Rule 101 – RPH Management, Sales, Admin Staff and Contractors shall not engage in or associate with conduct involving dishonesty, fraud, deceit or misrepresentation, or knowingly make a false or misleading statement.
Rule 102 – RPH Management, Sales, Admin Staff and Contractors has the following responsibilities regarding funds and/or other property of clients:
a) RPH Management, Sales, Admin Staff and Contractors who takes custody of all or any part of a client’s assets for any purposes, shall do so with the care required of a fiduciary;
b) In exercising custody of, or discretionary authority over, client funds or other property, RPH Management, Sales, Admin Staff and Contractors shall act only in accordance with the authority set forth in the set of specific direction;
c) RPH Management, Sales, Admin Staff and Contractors shall identify and keep complete records of all funds or other property of a client in the custody, or under the discretionary authority, of the RPH Management, Sales, Admin Staff and Contractors;
d) Upon receiving funds or other property of a client, RPH Management, Sales, Admin Staff and Contractors shall promptly or as otherwise permitted by law or provided by agreement with the client, deliver to the client or third party any funds or other property that the client or third party is entitled to receive and, upon request by the client or any person duly authorized, render a full accounting regarding such funds or other property;
e) RPH Management, Sales, Admin Staff and Contractors shall not commingle client funds or other property with his/her personal funds and/or other property or the funds and/or other property of the professional firm.
f) RPH Management, Sales, Admin Staff and Contractors shall not use, transfer, withdraw or otherwise employ funds or property for his or her fees, or for any other purpose not provided for in the engagement, except when authorized in writing by the client; and
g) A client’s assets in the custody of the RPH Management, Sales, Admin Staff and Contractors shall be used only for the means intended.
Rule 103 – RPH Management, Sales, Admin Staff and Contractors shall not solicit clients through false or misleading communications or advertisements, and for greater certainty:
a) RPH Management, Sales, Admin Staff and Contractors shall not make a false or misleading communication about the size, scope or areas of competence of the professional’s practice or of any organization with which the RPH Management, Sales, Admin Staff and Contractors is associated;
b) RPH Management, Sales, Admin Staff and Contractors shall not make false or misleading communications to the public or create unverifiable expectations regarding matters relating to student-athletic services or competence of the RPH Professional; and
c) RPH Management, Sales, Admin Staff and Contractors shall not give the impression that he/she is representing the views of Roster Point Hockey or any other group unless he/she has been authorized to do so.

Principle 2: Objectivity
RPH Management, Sales, Admin Staff and Contractors shall be objective in providing student-athlete services to clients.
Rule 201 – RPH Management, Sales, Admin Staff and Contractors shall exercise reasonable and prudent professional judgment in providing student-athlete services.
Rule 202 – RPH Management, Sales, Admin Staff and Contractors shall always act in the best interests of the client.

Principle 3: Competence
RPH Management, Sales, Admin Staff and Contractors shall provide student-athletic services to clients competently and maintain the necessary competence and knowledge to continue to do so in those areas in which the RPH Management, Sales, Admin Staff and Contractors is engaged.
Rule 301 – RPH Management, Sales, Admin Staff and Contractors shall offer advice only in those areas in which he/she is competent to do so. In areas where the RPH Management, Sales, Admin Staff and Contractors is not sufficiently competent, he/she shall seek the counsel of qualified individuals and/or refer clients to such parties.
Rule 302 – RPH Management, Sales, Admin Staff and Contractors shall abstain from intervening in the personal affairs of the client on matters outside the scope of the engagement.
Principle 4: Fairness
RPH Management, Sales, Admin Staff and Contractors shall perform student-athlete A RPH Management, Sales, Admin Staff and Contractors in a manner that is fair and reasonable to clients, principals, partners, and employers, and shall always disclose conflicts of interest in providing such services.
Rule 401 – RPH Management, Sales, Admin Staff and Contractors shall make timely written disclosure of all material information relative to the professional relationship. Written disclosures that include the following information are considered to be in compliance with this Rule:
a) A statement indicating whether the RPH Management, Sales, Admin Staff and Contractors ’s compensation arrangements involve fee-for-service, commission or bonus (which will not be the case under the NCAA Rules), salary, or any combination of the foregoing.
b) A statement describing the material terms of the relationships that RPH Management, Sales, Admin Staff and Contractors (or his/her firm) has with third parties, including the nature of the compensation arrangements.
c) A statement identifying any potential conflicts of interest.
Rule 403 – RPH Management, Sales, Admin Staff and Contractors shall not receive commissions or other forms of economic benefit from any party other than his/her client (this includes commissions or referral fees from schools, teams, hockey camps, training facilities, etc.). In the case where RPH Management, Sales, Admin Staff and Contractors is offered such a benefit, he shall; i) immediately disclose all pertinent and material facts to his/her client in writing, and ii) negotiate that the amount of the financial benefit goes the client through an agreed method;
Rule 404 – RPH Management, Sales, Admin Staff and Contractors shall inform the client of changes in circumstances and material information that arise after the original engagement that may have an impact on the professional relationship or services to be rendered.
Such changes include but are not limited to:
a) conflicts of interest;
b) the RPH Management, Sales, Admin Staff and Contractors business affiliation;
c) compensation structure affecting the professional services to be rendered; and
d) new or changed professional relationships.
Rule 405 – RPH Management, Sales, Admin Staff and Contractors shall not engage in discriminatory practices as defined in applicable human rights legislation.

Principle 5: Confidentiality
RPH Management, Sales, Admin Staff and Contractors shall maintain confidentiality of all client information.
Rule 501 – RPH Management, Sales, Admin Staff and Contractors shall not disclose any confidential client information without the specific consent of the client unless in response to proper legal or regulatory process. A client’s name shall not be disclosed to another party unless specific consent has been granted for the use of the client as a reference.
Rule 502 – RPH Management, Sales, Admin Staff and Contractors is bound to professional secrecy and may not disclose confidential information revealed by reason of his or her position or profession unless required by law.
Rule 503 – The use of client information for personal benefit is improper, whether or not it actually causes harm to the client.
Rule 504 – RPH Management, Sales, Admin Staff and Contractors shall maintain the same standards of confidentiality for employers as for clients while employed and thereafter.
Rule 505 – RPH Management, Sales, Admin Staff and Contractors doing business as a partner or principal of Roster Point Hockey, or as a licensee, owes to the firm(s), its advisory professional partners, contractors and/or co-owners a responsibility to act in good faith. This includes, but is not limited to, adherence to reasonable expectations of confidentiality both while in business together and thereafter.
Principle 6: Professionalism
RPH Management, Sales, Admin Staff and Contractors ’s conduct in all matters shall reflect credit upon the profession.
Rule 601 – RPH Management, Sales, Admin Staff and Contractors shall not engage in any conduct that reflects adversely on his or her integrity or fitness as an RPH Management, Sales, Admin Staff and Contractors, upon the Trademarks, or upon the profession.
Rule 602 – RPH Management, Sales, Admin Staff and Contractors shall use the Trademarks in compliance with the rules and regulations of Roster Point Hockey, as established and amended from time to time.
Rule 603 – RPH Management, Sales, Admin Staff and Contractors who has knowledge that another affiliated RPH Management, Sales, Admin Staff and Contractors has committed a violation of this License, which raises substantial questions as to the RPH Management, Sales, Admin Staff and Contractors ’s honesty, trustworthiness or fitness as an RPH Management, Sales, Admin Staff and Contractors in other respects, shall promptly inform the President of Roster Point Hockey.
This rule does not require disclosure of information or reporting based on knowledge gained as a consultant or expert witness in anticipation of or related to litigation or other dispute resolution mechanisms. For purposes of this rule, knowledge means no substantial doubt.
Rule 604 – RPH Management, Sales, Admin Staff and Contractors shall not criticize another RPH Management, Sales, Admin Staff and Contractors without first submitting this criticism to the other RPH Management, Sales, Admin Staff and Contractors for explanation. Where the criticism may result in a complaint being lodged with Roster Point Hockey, the RPH Management, Sales, Admin Staff and Contractors must, where required, first submit that criticism in writing to RPH Management, for explanation. Notwithstanding this rule, RPH Management, Sales, Admin Staff and Contractors may first submit a criticism of another RPH Management, Sales, Admin Staff and Contractors to the President of Roster Point Hockey, should the matter be considered of such a nature that prior notice is not appropriate.
Rule 605 – RPH Management, Sales, Admin Staff and Contractors who has knowledge that raises a substantial question of unprofessional, fraudulent or illegal conduct by RPH Management, Sales, Admin Staff and Contractors or other associated professional, shall promptly inform the appropriate regulatory and/or professional disciplinary body. This rule does not require disclosure or reporting of information gained as a consultant or expert witness in anticipation of or related to litigation or other dispute resolution mechanisms. For purposes of this Rule, knowledge means no substantial doubt.
Rule 606 – RPH Management, Sales, Admin Staff and Contractors who has reason to suspect illegal conduct within the RPH Management, Sales, Admin Staff and Contractors organization shall make timely disclosure of the available evidence to the RPH Management and/or partners or co-owners. If the RPH Management, Sales, Admin Staff and Contractors is convinced that illegal conduct exists within the RPH Management, Sales, Admin Staff and Contractors ’s organization, and that appropriate measures are not taken to remedy the situation, the RPH Management, Sales, Admin Staff and Contractors shall, where appropriate, alert the appropriate regulatory authorities including the President of Roster Point Hockey in a timely manner.
Rule 607 – RPH Management, Sales, Admin Staff and Contractors shall perform student-athlete services in accordance with applicable laws, rules, regulations and established policies of governmental agencies or other applicable authorities, as well as Roster Point Hockey.
Rule 608 – RPH Management, Sales, Admin Staff and Contractors shall not adopt any method of obtaining or retaining clients that tends to lower the standard of dignity of the profession.
Rule 609 – RPH Management, Sales, Admin Staff and Contractors shall not practice any other profession or offer to provide such additional services unless the RPH Management, Sales, Admin Staff and Contractors is qualified to practice in those fields and is
licensed or registered as required by law.
Rule 610 – RPH Management, Sales, Admin Staff and Contractors shall return the client’s original records in a timely manner after their return has been requested by the client.
Rule 611 – RPH Management, Sales, Admin Staff and Contractors shall not bring or threaten to bring a disciplinary proceeding under this License, or report or threaten to report information to Roster Point Hockey pursuant to Rules 602 or 603 or make or threaten to make use of this License for no substantial purpose other than to harass, maliciously injure, embarrass and/or unfairly burden another RPH Management, Sales, Admin Staff and Contractors .
Principle 7: Diligence
RPH Management, Sales, Admin Staff and Contractors shall act diligently in providing student-athletic services.
Rule 701 – RPH Management, Sales, Admin Staff and Contractors shall enter into a client engagement only after securing sufficient information to be satisfied that the relationship is warranted by the individual’s needs and objectives, and that RPH Management, Sales, Admin Staff and Contractors has the ability to either provide the requisite competent services or to involve and supervise other professionals who can provide such services.
Rule 702 – RPH Management, Sales, Admin Staff and Contractors shall make only those recommendations that are suitable for the client. It is the client’s responsibility to perform their own due diligence on any and all opportunities put forth by RPH Management, Sales, Admin Staff and Contractors.
Rule 703 – Consistent with the nature and scope of the engagement, RPH Management, Sales, Admin Staff and Contractors shall carry out a reasonable investigation regarding the opportunities recommended to clients. It is the client’s responsibility to perform their own due diligence on any and all opportunities put forth by RPH Management, Sales, Admin Staff and Contractors.
Such an investigation may be made by the RPH Management, Sales, Admin Staff and Contractors or by others provided the RPH Management, Sales, Admin Staff and Contractors acts reasonably in relying upon such investigation. It is the client’s responsibility to perform their own due diligence on any and all opportunities put forth by RPH Management, Sales, Admin Staff and Contractors.
Rule 704 – RPH Management, Sales, Admin Staff and Contractors shall properly supervise subordinates with regard to their delivery of student-athletic services and shall not accept or condone conduct in violation of this License.

PART III – Athlete Contract Rules
Billing and Payment
Invoices will be issued upon signed agreement and are due upon receipt. Work to promote a player will not begin until payment is made. If a split payment program is in place first deposit must be made before RPH will begin any work.

Athlete/RPH Agreement
This Athlete/RPH Agreement is between an athlete if over 18 years of age or the parents / guardian of the athlete and RPH who will market the Athlete’s works or promote the athlete individually. This agreement sets out the specifics of the arrangement and effective date of the agreement and commission RPH will receive. It also sets out how RPH will be paid and reasons for termination of the agreement.
It is beneficial to all parties that the agreement be clearly spelled out in writing. This Athlete/RPH Agreement will prove invaluable in the event of disagreements, misunderstandings or litigation between the athlete and the RPH.
Instructions and Checklist
Athlete/RPH Agreement
 The parties should read the document carefully.
 Insert all requested information in the spaces provided on the form.
 Read the “RPH Covenants” provision carefully. If the covenants are ambiguous, describe fully and set forth examples to remove as much ambiguity as possible.
 Read the “Commission ” provision carefully. If there are disagreements, they will likely focus on this provision.
 This form contains the basic terms and language that should be included in similar agreements.
 This agreement must be signed by both the athlete if over 18 years of age or the parents / guardian of the athlete and the RPH.
 The parties should retain either an original or copy of the signed agreement.
 All legal documents should be kept in a safe location such as a fireproof safe or safe deposit box.
 It is the responsibility of the athlete if over 18 years of age and or the parents / guardian of the athlete to due their due diligence when considering any hockey opportunity regardless of it being recommended by RPH Management, Sales, Admin Staff and Contractors, any other player advisory service or the opportunity itself.
